On Tuesday June 14 2015, the U.S. House of Representatives Energy & Commerce Committee’s Subcommittee on Communications and Technologyheld a hearing FCC Overreach: Examining the Proposed Privacy Rules. The hearing follows up on a letter sent to FCC Chairman Tom Wheeler regarding the agency’s proposed privacy and data breach notification requirements for broadband ISPs. The FTC had its jurisdiction removed when the FCC reclassified broadband as a common carrier. The letter suggests the FCC’s making a separate set of rules governing only ISPs, and not other parts of the Internet ecosystem, would “create confusion and harm competition”. Witnessess were Doug Brake, Telecommunications Policy Analyst, Information Technology and Innovation Foundation; Jon Leibowitz Co-Chair, 21st Century Privacy Coalition (and former FTC Chair); and Paul Ohm, Professor, Center on Privacy and Technology, Georgetown University Law Center.
