How has the so-called Right to be Forgotten evolved over the last decade since the landmark ruling Google Spain SL v. Agencia Española de Protección de Datos in 2014? Global Freedom of Expression will report the findings of a Special Collection paper ‘Does our past have a right to be forgotten by the Internet?‘, which surveyed jurisprudence around the world to understand how courts in different jurisdictions have understood and adjudicated these rights claims. French legal scholars will present recent case law from French courts to illustrate emerging norms. The panelists from France and Argentina will discuss the complexities and impacts of de-indexing, deleting, or anonymizing content, and how judges around the globe are dealing with the challenges posed by the social processes of memory and forgetting on the Internet. They will also consider trends in legal reasoning when it comes to balancing freedom of expression with privacy, intermediary liability, reputation, and the special duties of public figures.

Comment le soi-disant droit à l’oubli a-t-il évolué au cours de la dernière décennie depuis l’arrêt historique Google Spain SL c. Agencia Española de Protección de Datos en 2014 ? Global Freedom of Expression rapportera les conclusions d’un article de la collection spéciale « Notre passé a-t-il le droit d’être oublié par Internet ? », qui a étudié la jurisprudence à travers le monde pour comprendre comment les tribunaux de différentes juridictions ont compris et statué sur ces revendications de droits. Des juristes français présenteront la jurisprudence récente des tribunaux français pour illustrer les normes émergentes. Les panélistes de France et d’Argentine discuteront des complexités et des impacts de la désindexation, de la suppression ou de l’anonymisation du contenu, et de la manière dont les juges du monde entier font face aux défis posés par les processus sociaux de mémoire et d’oubli sur Internet. Ils examineront également les tendances du raisonnement juridique lorsqu’il s’agit de concilier la liberté d’expression avec la vie privée, la responsabilité des intermédiaires, la réputation et les devoirs particuliers des personnalités publiques.
