On Wednesday June 15 2015 the New York State Public Service Commission held a Public Statement Hearing at the NY Institute of Technology in NYC on the recently issued Department of Public Service Assessment Report on the State of Telecommunications in New York. Today Thursday February 26 2015 the Federal Communications Commission (FCC) will hold an Open Commission Meeting. Topics under consideration are Community Broadband – the Commission will “consider a Memorandum Opinion and Order addressing petitions filed by two municipal broadband providers asking that the Commission preempt provisions of state laws in North Carolina and Tennessee that restrict the abilities of communities to provide broadband service”: and Protecting and Promoting the Open Internet – the Commission will “consider a Report and Order on Remand, Declaratory Ruling, and Order that responds to the Verizon court remand and adopts strong open Internet rules, grounded in multiple sources of the Commission’s legal authority, to ensure that Americans reap the economic, social, and civic benefits of an open Internet today and into the future”. The meeting will be webcast live.

On Tuesday November 18 2014 Next Century Cities and the Southeast Tennessee Development District will hosted a field hearing “Envisioning a Gigabit Future” in Chattanooga. The event runs from 9 a.m. to 1 p.m. EST. For example, Tennessee is one of about twenty states that restrict community broadband choice, prompting Chattanooga and Wilson, North Carolina (another such state), to petition the Federal Communications Commission to remove these restrictions so that Chattanooga and Wilson can expand their highly successful networks.

On September 4 2014 FCC Chairman Tom Wheeler delivered a speech “The Facts and Future of Broadband Competition” at 1776 in Washington DC. While currently the FCC defines broadband as a 4/1mbps Internet connection, and is considering raising that to 10/?mpbs, Chairman Wheeler suggested that, given the number of devices in the average home, 25mbps down was “table stakes in 21st century communications”. Deprecating the abilty of DSL or wireless to meet the demand, he outlined the lack of competition in the current marketplace, as indicate in the chart below.

Chairman Wheeler outlined a four point FCC plan to increase competition:

Where competition exists, the FCC will protect it.
Where greater competition can exist, the FCC will encourage it.
Where meaningful competition is not available, the FCC will work to create it.
Where competition cannot be expected to exist, the FCC must shoulder the responsibility of promoting deployment.

On the topic of net neutrality he affirmed his belief that “minimum service requirements will suffice”, and made no comment about mergers.

On Wednesday, May 28, 2014 the Open Technology Institute (OTI) presented a panel – Localism Over Consolidation: An Exploration of Public Broadband Options – in Washington DC, a discussion of various approaches to local investment in broadband. The panel featured a diverse set of experts on public broadband networks and projects, including the manager of a municipal fiber network in Wilson, NC. Panelists discussed different approaches communities have taken so far and share thoughts on what steps other local governments can take going forward to support access to affordable and high-speed broadband. On Monday May 19 2014 NYC Mayor Bill de Blasio delivered the opening address at Internet Week NY, which takes place all this week. In his remarks the Mayor emphasized the need for improved Internet access in the city saying “Our approach is going to be bold and it’s going to be decisive, because we simply haven’t done enough in this city.” He promised to reexamine whether Verizon and Time Warner Cable are living up to their franchise agreements, and to form a Broadband Task Force. On February 27–28, 2014 Fordham University’s Urban Law Center will hold a 2-day symposium – Smart Law for Smart Cities: Regulation, Technology, and the Future of Cities. This symposium will explore the regulatory landscape for potentially disruptive advances in urban governance arising from innovative technology, sustainability, and “big data.” It will focus on how contemporary urban life is marked and shaped by technology, as well as the law and regulatory complexities that are arising from this technological transformation. The symposium will include panels examining changes to both the physical and non-physical landscape in urban life resulting from such changes. Speakers include Bruce Lincoln of Silicon Harlem, Dana Spiegel of NYC Wireless, Manhattan Borough President Gale Brewer, and Chris Levendos of Verizon. Non-lawyer registration is $75 for the two days. The entire conference will be webcast live via the Internet Society Chapters livestream channel.
