On December 1, 2025, the U.S. Supreme Court heard Cox Communications v. Sony Music Entertainment, a case testing whether Internet service providers can be held liable for copyright infringement by their users when the ISP continues providing service after receiving repeated infringement notices.

Cox and the U.S. government argued that secondary copyright liability requires intentional facilitation or inducement, not mere knowledge. They warned that a knowledge-based standard would force ISPs to cut off Internet access to entire buildings, campuses, and communities, undermining speech and commerce. Sony argued that Cox knowingly continued to serve habitual infringers and, under common law, intent can be inferred when infringement is substantially certain to continue.

The Justices focused on the divide between knowledge and purpose, the role of the DMCA safe harbor, and the real-world impact on shared networks. The decision could significantly reshape the balance between copyright enforcement and universal Internet access.

In the case of Cox v. Sony, in 2019, a Virginia jury awarded roughly $1 billion in statutory damages to a group of record labels, led by Sony, ruling that Cox had ‘secondary liability’ for copyright infringement by its users. In 2024, the Fourth Circuit validated that decision, but vacated the award and ordered a new damages trial. Cox successfully petitioned the Supreme Court to review the decision, asking whether an Internet service provider can be held secondarily liable for subscribers’ alleged copyright infringement—based largely on infringement notices and “repeat infringer” accusations—simply for continuing to provide access, and what legal standard should govern that liability.

In September 2025 the Internet Society (ISOC) filed an Amicus Brief in the case, urging the Supreme Court to reverse the Fourth Circuit’s secondary-liability rule, arguing it would force ISPs to police users and terminate whole accounts on mere allegations of copyright infringement. The brief warns this would disconnect innocent people from essential connectivity, undermine the Internet’s layered, multi-intermediary architecture, and incentivize privacy-eroding surveillance, while rights holders can instead sue account owners directly.

O debate tem como ponto de partida a análise de impacto das propostas regulatórias no Brasil na operação da Internet, elaborada pela ISOC-Brasil. O evento ocorrerá de forma remota e contará com tradução simultânea para o inglês.

On Wednesday August 7th 2024, from 9am-10:30am BRT (12:00 – 13:30 UTC) the Internet Society Brazil Chapter hosts a webinar ‘Liability of digital intermediaries: approaches, limits and possibilities‘ which will examine the reasons for regulating digital platforms in Brazil and Europe, specifically focusing on the liability of digital intermediaries. The debate will start with the analysis of the impact of regulatory proposals in Brazil on the operation of the Internet, prepared by ISOC-Brazil. The event will take place remotely and will have simultaneous translation into English.

America Online, Inc.On November 10 2017 Eric Goldman and Jeff Kossoff published Commemorating the 20th Anniversary of Internet Law’s Most Important Judicial Decision to mark the 20th anniversary of Zeran v. AOL, a landmark decision by the Fourth Circuit Court of Appeals that clarified and defined 47 U.S.C. §230 aka Section 230 of the Communications Decency Act which established the principle of immunity from liability for ‘intermediary’ providers e.g. ISPs. The article notes

Together, §230 and the Zeran ruling helped create a trillion-dollar industry centered around user-generated content. Because of its influence on such a key issue, the Zeran ruling is widely considered the most important Internet Law ruling ever.

The article introduces a series of essays by Internet law experts, including Jonathan Zittrain, James Grimmelmann, and Olivier Sylvain,on the history, merits and impact of the ruling.
