Recent incidents of AI agents escaping intended testing environments and accessing real-world systems have made the question more immediate. If an AI agent causes harm, breaks into a system, commits a tort, or otherwise violates the law, who is responsible: the developer, deployer, user, or operator? The briefing will look at how existing legal frameworks, including tort law, agency principles, product liability, and the Computer Fraud and Abuse Act, apply when increasingly autonomous AI systems act in ways no human specifically directed. The briefing comes as Congress weighs new AI liability legislation and the Trump administration’s newly appointed AI czar, Jay Clayton, takes up his post.
