VIDEO: Bali and Beyond: An Internet Governance Forum Debrief #igf @isocdc

Bali and Beyond

Bali and BeyondOn Friday November 8 2013 the Internet Society Washington DC Chapter presented a forum – Bali and Beyond: An Internet Governance Forum Debrief – at the Microsoft Innovation & Policy Center, Washington, DC.

Late last month, more than a thousand delegates from almost a hundred countries gathered for four days at the eighth Internet Governance Forum in Bali, Indonesia, to discuss a wide range of issues related to the future of the Internet–from online privacy to management of domain names to NSA surveillance to human rights in cyberspace. Much of the discussion in Bali revolved around a proposal by ICANN and the Brazilian government to hold a high-level conference on Internet issues in Brazil in late April or early May. At this event more than a dozen IGF participants shared their observations and experiences and participated in a public forum. It was webcast live via the Internet Society Chapters Channel.

TODAY: Territorial Rights Versus Globalized #Surveillance @JohnJayCollege

John Jay College

John Jay CollegeToday, Tuesday 12 November 2013 the Center for Cybercrime Studies at John Jay College will present a lecture – Territorial Rights Versus Globalized Surveillance – by Professor Adina Schwartz.

The National Security Agency (“NSA”)’s upstream and PRISM programs are based on technology that enables analysts within the United States to intercept the Internet and telephone communications of people throughout the world. The legal basis for the programs, however, is a territorial distinction. The FISA Amendments Act authorizes warrantless surveillance of the contents of communications if the target of the surveillance is not a United States national and is reasonably believed to be located outside the United States. Through an analysis of the NSA’s upstream and PRISM data collection programs, this paper explores the question: when technology erases territorial limitations on a nation’s surveillance power, should individuals’ legal rights against such surveillance depend on their nationality and geographical location?

To our knowledge there is no recording or webcast planned, so it will be necessary to attend in person.

VIDEO: Shira Perlmutter – From Paralysis to Progress: The (Useful) Art of Copyright Pragmatism @thecsusa #copyright

On November 4 2013 the Copyright Society of the USA presented the 43rd annual Donald C. Brace Memorial Lecture featuring Shira Perlmutter, Chief Policy Officer and Director for International Affairs at the United States Patent and Trademark Office. Ms. Perlmutter’s topic was From Paralysis to Progress: The (Useful) Art of Copyright Pragmatism . For most of our country’s history, copyright policy and legislation were largely immune from the partisan rancor that has long characterized other areas such as tax policy, social programs, and privacy protection. The organized revolt against recent efforts to enhance copyright protections, including the Stop Online Piracy Act (SOPA) and Protect IP Act (PIPA), underscores that things have changed. Panelists Derek Khanna and Ben, who come from both sides of the debate, explored the competing interests and ideologies that brought us here, and how the heightened role of politics in copyright policy is likely to play out. VIDEO: Content Aggregation: Fair Use or a Use Too Far? @theCSUSA #copyright

On October 24 2013 the Copyright Society of the USA NY Chapter presented: Content Aggregation: Fair Use or a Use Too Far? at the Princeton Club in NYC. Some of the most popular websites are based upon the aggregation of other parties’ published news, photos, television clips and other content. Aggregators who collect and post third-party content tout the utility of their “one-stop viewing” sites and argue that theirs is a fair use of the content. Content owners, however, complain that aggregators profit from their content without providing fair compensation, and that they are not benefiting from the recent surge in digital advertising revenues received by big technology companies such as Google and Facebook. Two recent decisions in the Southern District of New York have re-focused attention on this increasingly important topic: The Associated Press v. Meltwater, in which the court ruled that a media monitoring service’s aggregation of news story excerpts provided to paying subscribers was not fair use, and Authors Guild v. HathiTrust (now on appeal to the Second Circuit), in which the court upheld the creation of an index based on Google’s scanning of millions of books in its library project as fair use. Further, in September Judge Chin heard oral argument in Authors Guild v. Google on whether the posting of book excerpts on Google Books qualifies as fair use, and Fox News recently sued TVEYES, an aggregator of clips from television broadcasts. The panel discussed the evolving law and public policy issues related to these cases and the broader topic of aggregation. Panelists: Bill Herman, Hunter College CUNY; Andy Sellars, Digital Media Law Project and Berkman Center for Internet & Society; and Linda Steinman, Davis Wright Tremaine LLP. Moderator was Elizabeth McNamara, Davis Wright Tremaine LLP. Video/audio is below.
